To what extent are the answers to theological questions knowable? And if the relevant answers are knowable, which sorts of inquirers are in a position to know them? In this chapter we shall not answer these questions directly but instead supply a range of tools that may help us make progress here. The tools consist of plausible structural constraints on knowledge. After articulating them, we shall go on to indicate some ways in which they interact with theological scepticism. In some (...) cases the structural constraints bear directly on whether one can know answers to theological questions. But the structural considerations are related to theological scepticism in other interesting ways as well; for instance we will also be using them to explore the significance of scepticism, by addressing questions such as ‘To what extent does it matter whether or not we can know the answer to theological questions?’. The text itself, nonetheless, is troublesomely complex. It is a very difficult work to interpret with both honesty and confidence. Melville unflinchingly represents to us the moral horror of what Captain Vere does to Billy, and yet he also depicts Vere himself with a respect that borders on admiration. The attentive reader experiences a painful cognitive dissonance that can only be soothed by a coherent interpretation, and perhaps by a bit of philosophy.Given the way in which the text of Billy Budd emerged—it was assembled by scholars, long after Melville's death, from a confusing collection of manuscript pages he had left behind when he died—it may well be an unfinished work. The rights concerning ownership to, and inheritance of, property are generally looked to as natural and taken for granted. In this article we ask why the rights of inheritance usually priorities consanguine bonds and how this arrangement originated. As rights to property and inheritance was non-existent or only of minor importance in ancient hunter and gathering societies, we assume that these phenomena arose or became socially significant only with the development of agriculture and livestock breeding. In different agricultural societies the (...) institutionalisation (and naturalisation) of inheritance rights took form in accordance with the kinship and symbolic systems of each. Here we take a closer look at two legal institutions in two different societies: the Jubilee of the Ancient Israelites (as accounted for in the Book of Leviticus) and the allodial rights of early mediaeval Norway (as represented in the Gulathing Law). We interpret these two institutions in terms of local kinship and symbolic systems and compare them to the ideas on natural law forwarded by John Locke, which in modern times has served as the foundation on which laws on property and inheritance are legitimised. Svend Erik Stybe (1919-1995) var en dansk idéhistoriker og forfatter, der udgav et væld af bøger om både dansk og europæisk filosofi- og idéhistorie gennem de sidste mange hundrede år. The issue of how to justify right and wrong is a recurring methodological problem in ethics. We can, somewhat simplified, distinguish between people who argue that right and wrong must be confirmed by our moral convictions and people who maintain that morality must be justified by principles independent from these convictions. The issue hinges on arriving at a standard or criterion for when something is right or wrong. The author discusses this issue in light of the distinction between perfect procedural (...) justice and pure procedural justice, drawing on the works of John Rawls and Peter Singer. One shortcoming affecting both these approaches is how they are unable to account for our basic beliefs. Using Ludwig Wittgenstein’s On Certainty as a point of departure, the author attempts to demonstrate that some of our basic beliefs cannot be formulated in propositions, but rather are expressed by our actions. The author concludes that we, in light of this, must distinguish between our ethical propositions and our basic beliefs. The former may be subject to doubt and may, consequently, be expressed in the form of propositions, whereas the latter is only expressed by what we say and what we do. (shrink)

Den dominerende oppfatningen i den politiske og moralfilosofiske tenkningen de siste tiår har vært at religion ikke bør spille noen avgjørende politisk rolle i det moderne sekulariserte demokrati. Religion tilhører privatsfæren, og politiske avgjørelser må fattes på et felles grunnlag, uavhengig av livssyn. De mest sentrale tenkerne i vår tids politiske filosofi, John Rawls og Jürgen Habermas, har begge i tidlige arbeider gitt uttrykk for at dette er en oppfatning som vil få en allmenn, global tilslutning, for de ser (...) modernisering og sekularisering som to sider av samme sak. Det er nærmest to uunngåelige fenomen ettersom globalisering og modernisering vil føre til svekkelse av tradisjonelle kulturer og utbredelse av individualisme og demokratiske idealer. Bakgrunnen for dette temanummeret er at en rekke erfaringer fra de siste tiår har ledet til en gjenåpning av spørsmålet om religionens plass i sekulariserte samfunn. (shrink)

I begin with the story told by Herman Melville in his short novel, Billy Budd.The year is 1797. Britain is engaged in a long and bitter war against France, and the British war effort has been threatened by two naval mutinies: the Nore Mutiny and the mutiny at Spithead. The scene is His Majesty’s Ship, the Indomitable, and the central character is Billy Budd, sailor. Billy Budd is a young man of exceptional beauty, both physical and moral, (...) whose only flaw is a stammer. He is loved by all his fellow sailors except the master-at-arms, John Claggart. The incarnation of evil, Claggart recognises in Billy the incarnation of goodness, and is consumed by a jealousy which leads him to accuse Billy (falsely) of inciting the crew to mutiny. Alone with Claggart and the ship’s Captain, Edward Vere, Billy hears the lying charge against him. He is enraged, but his stammer prevents him from responding in words. He strikes Claggart, and the blow is fatal. Billy Budd, sailor, has killed the master-at-arms of one of His Majesty’s ships on active service, and the penalty for this is death. (shrink)

Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition.

Lockean approaches to property take it that persons can unilaterally acquire private ownership over hitherto unowned resources. Such natural law accounts of property rights are often thought to be of limited use when dealing with the complexities of natural resource use outside of the paradigm of private ownership of land for agricultural or residential development. The tragedy of the commons has been shown to be anything but an inevitability, and yet Lockeanism seems to demand that even the most robust common (...) property arrangements be converted to privatized units. This often motivates a move away from natural law in the moral analysis of property rights. I argue however that it is not the deontological nature of Lockean principles that are at fault, but rather the manner of their application. Lockean theory often exhibits a bias in favour of private property: assuming that only private property can protect one’s interest in autonomy, and therefore asserting that each individual has a power of private acquisition. Starting with a claim against interference however enables us to mould the appropriate property rights to each individual’s particular interest in autonomy. This sometimes leads to private ownership, but often leads to various forms of commons. (shrink)

Reissued here in its corrected second edition of 1864, this essay by John Stuart Mill argues for a utilitarian theory of morality. Originally printed as a series of three articles in Fraser's Magazine in 1861, the work sought to refine the 'greatest happiness' principle that had been championed by Jeremy Bentham, defending it from common criticisms, and offering a justification of its validity. Following Bentham, Mill holds that actions can be judged as right or wrong depending on whether they (...) promote happiness or 'the reverse of happiness'. Although attracted by Bentham's consequentialist framework based on empirical evidence rather than intuition, Mill separates happiness into 'higher' and 'lower' pleasures, arguing for a weighted system of measurement when making and judging decisions. Dissected and debated since its first appearance, the essay is Mill's key discussion on the topic and remains a fundamental text in the study of ethics. (shrink)

This book gives an account of a full spectrum of property rights and their relationship to individual liberty. It shows that a purely deontological approach to justice can deal with the most complex questions regarding the property system. Moreover, the author considers the economic, ecological, and technological complexities of our real-world property systems. The result is a more conceptually sound account of natural rights and the property system they demand. If we think that liberty should be at the centre of (...) justice, what does that mean for the property system? Economists and lawyers widely agree that a property system must be composed of many different types of property: the kind of private ownership one has over one's person and immediate possessions, as well as the kinds of common ownership we each have in our local streets, as well as many more. However, theories of property and justice have not given anything approaching an adequate account of the relationship between liberty and any other form of property other than private ownership. It is often thought that a basic commitment to liberty cannot really tell us how to arrange the major complexities of the property system, which diverge from simple private ownership. Property and Justice demonstrates how philosophical rigour coupled with interdisciplinary engagement enables us to think clearly about how to deal with real-world problems. Hillel Steiner argues that a necessary and sufficient condition for the compossibility of a set of rights is that those rights be extensionally differentiable. However, given that two or more actions can extensionally overlap without thereby being mutually unperformable, if such actions are specified in the relevant rights, then those rights will not be incompossible, notwithstanding their extensional overlap. The set of compossible sets of rights then is greater than the subset of extensionally differentiable rights, and extensional differentiability is a (...) sufficient but unnecessary condition of compossibility. We are becoming increasingly dependent on robots and other forms of artificial intelligence for our beliefs. But how should the knowledge gained from the “say-so” of a robot be classified? Should it be understood as testimonial knowledge, similar to knowledge gained in conversation with another person? Or should it be understood as a form of instrument-based knowledge, such as that gained from a calculator or a sundial? There is more at stake here than terminology, for how we treat objects as (...) sources of knowledge often has important social and legal consequences. In this paper, I argue that at least some robots are capable of testimony. I make my argument by exploring the differences between instruments and testifiers on a well-known account of knowledge: reliabilism. On this approach, I claim that the difference between instruments and testifiers as sources of knowledge is that only the latter are capable of deception. As some robots can be designed to deceive, so they too should be recognized as testimonial sources of knowledge. (shrink)

Over the centuries the term “talent” has changed semantically and slowly transformed itself into a floating signifier or become an accidental designator. The term “talent” no longer has one single meaning and a “referent” in real life, but instead a multiplicity of meaning and references to something beyond real life, something indefinite and indefinable. In other words, today we do not know specifically what the term “talent” in talent management really means or refers to. Indeed, this is problematical, because in (...) late modernity the term “talent” has become a popular and frequently used key term among business consultants and, within the science of human resource management, a cornerstone in the discipline of “talent management”, and not knowing what the term really means will turn any talent discussion, talent identification and talent recruitment into a question of subjectivity and belief in talent rather than objectivity and knowledge of talent. J.L. Mackie insists that ordinary evaluative thought presents itself as a matter of sensitivity to aspects of the world. And this phenomenological thesis seems correct. When one or another variety of philosophical non-cognitivism claims to capture the truth about what the experience of value is like, or (in a familiar surrogate for phenomenology) about what we mean by our evaluative language, the claim is never based on careful attention to the lived character of evaluative thought or discourse. The idea is, (...) rather, that the very concept of the cognitive or factual rules out the possibility of an undiluted representation of how things are, enjoying, nevertheless, the internal relation to 'attitudes' or the will that would be needed to count as evaluative. On this view the phenomenology of value would involve a mere incoherence, if it were as Mackie says--a possibility that then tends (naturally enough) not to be so much as entertained. But, as Mackie sees, there is no satisfactory justification for supposing that the factual is, by definition, attitudinatively and motivationally neutral. This clears away the only obstacle to accepting his phenomenological claim; and the upshot is that non-cognitivism must offer to correct the phenomenology of value, rather than give an account of it. -/- In Machie's view the correction is called for. In this paper I want to suggest that he attributes an unmerited plausibility to this thesis, by giving a false picture of what one is committed to if one resists it. (shrink)

This new study provides a refreshing look at the issue of exceptions and shows that much of the problem stems from a failure to recognize at least two kinds of exception-ridden law: ceteris paribus laws and ideal laws. Billy Wheeler offers the first book-length discussion of ideal laws. The key difference between these two kinds of laws concerns the nature of the conditions that need to be satisfied and their epistemological role in the law’s formulation and discovery. He presents (...) a Humean-inspired approach that draws heavily on concepts from the information and computing sciences. Specifically, Wheeler argues that laws are best seen as algorithms for compressing empirical data and that ideal laws are needed as 'lossy compressors' for complex data. Major figures in the metaphysics of science receive special attention such as Ronald Giere, Bas van Fraassen, Nancy Cartwright, David Lewis and Marc Lange. This book is essential reading for philosophers of science and will interest metaphysicians, epistemologists and others interested in applying concepts from computing to traditional philosophical problems. Many libertarians ground their theory of justice in a non-aggression principle. The NAP is often the basis for the libertarian condemnation of state action – that it is necessarily aggressive and therefore unjust. This approach is often criticised insofar as it defines aggression, in part, as the violation of legitimate property rights, and is therefore parasitical upon a prior – and unjustified – theory of property. While it is true that libertarians who defend the NAP sometimes fail to give a (...) satisfactory account of its relationship to libertarian property rights, such an account is in fact available. A commitment to property rights and to non-aggression can both be grounded in a commitment to non-interference. Such a principle, then, brings together the NAP and the theory of property it is parasitical upon, thus saving the unity and austerity of the overall approach. (shrink)

This paper looks at the phenomenon of ethical vagueness by asking the question, how ought one to reason about what to do when confronted with a case of ethical vagueness? I begin by arguing that we must confront this question, since ethical vagueness is inescapable. I then outline one attractive answer to the question: we ought to maximize expected moral value when confronted with ethical vagueness. This idea yields determinate results for what one rationally ought to do in cases of (...) ethical vagueness. But what it recommends is dependent on which substantive theory of vagueness is true; one can't draw conclusions about how to reason about vagueness in ethics in the absence of concrete assumptions about the nature of vagueness. In his preface Mr Wilson writes 'I feel that a great many adults … would do better to spend less time in simply accepting the concepts of others uncritically, and more time in learning how to analyse concepts in general'. Mr Wilson starts by describing the techniques of conceptual analysis. He then gives examples of them in action by composing answers to specific questions and by criticism of quoted passages of argument.
